This presentation will explore the growth of social media, which is used extensively by members of the adult industry, social media legislation, tips and advice for using social media when involved with litigation, how to avoid creating “bad” evidence, how social media can be used at trial, spoliation of evidence, and a discussion of recent court cases involving social media and The First Amendment. The presentation will conclude with a question and answer session.
A “nuts and bolts” discussion of 18 U.S.C. §2257, the Federal Record Keeping Statute, and the new MasterCard requirements for adult content and service. Topics covered will include the nature of the recordkeeping statute, the Federal regulations enacted to implement it, an update on the most recent cases relating to the constitutionality of 2257, as well as a summary of MasterCard’s new rules which affect the provision of adult content and services, including, among other things, the rules relating to consent, age and identity verification, and merchant requirements to screen, review and monitor content prior to publication. There will be an opportunity for questions after the presentation.
