This presentation explores the nature of social media and how it has created new legal concerns and challenges, particularly with regard to the First Amendment. Topics discussed include defining social media; legislation affecting social media; the public policy behind the First Amendment; and a discussion of cases decided in recent years that have involved the interplay of social media and the First Amendment has been applied to social media cases. The presentation will also briefly discuss The Corporate Transparency Act, a federal law that took effect on January 1, 2024 and requires millions of business entities to report certain information about their entity and their beneficial owners to the United States Treasury Department’s Financial Crimes Enforcement Network. There will be an opportunity for questions after the presentation. ALSO, Just in case you are not aware, your LLC/business entity may be subject to the Corporate Transparency Act, which I am speaking about this year on Day 2 of my presentations.
